WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOLDEN GROND LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

Indemnification

You agree to indemnify, defend, and hold harmless Folden Grond LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your violation of these terms, misuse of the service, or violation of any applicable law.

Dispute Resolution & Arbitration

Governing Law. These terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles.

Mandatory Arbitration. Any dispute, controversy, or claim arising out of or relating to these terms or the service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Wyoming or, at your election, via telephone or video conference.

Exceptions. Either party may bring a claim in small claims court if the claim qualifies. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.

Opt-Out. You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these terms. Your notice must include your account number and a clear statement that you wish to opt out of arbitration.

Class Action Waiver

YOU AND FOLDEN GROND LLC AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, both parties waive the right to a jury trial.

Copyright & DMCA Notices

We do not monitor, log, or inspect the content of VPN traffic. If we receive a DMCA or copyright notice, we cannot identify the user responsible because we do not store originating IP addresses, browsing history, or traffic content. We will respond to valid legal process in accordance with applicable law.

Termination

We may terminate or suspend accounts that violate these terms, at our sole discretion and without prior notice. You may cancel your subscription at any time. Upon termination, your right to use the service ceases immediately.

Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations (except payment obligations) where such failure or delay results from causes beyond its reasonable control, including but not limited to natural disasters, war, terrorism, government actions, power failures, internet disruptions, or infrastructure provider outages.

Severability

If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.

Entire Agreement

These terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Folden Grond LLC regarding the service and supersede all prior agreements.

Changes

We may update these terms at any time. Material changes will be posted on our website. Your continued use of the service after changes are posted constitutes acceptance of the updated terms.
